Terms of Use

Updated and effective as of August 7, 2017.

These terms apply to your use of inpropriapersona.com (the “site” or the “website”), a non-commercial site currently controlled (though it may be hosted elsewhere) from the State of California in the United States by Kristopher A. Nelson (“us” or “we”). These terms apply solely to inpropriapersona.com. Note: In using the site, third-party services may also be involved; in such situations, their terms apply, not ours.

We may change these terms from time to time and you may not be explicitly notified of such changes. Your access to this site signifies your acceptance of these terms.

You may also wish to consult our privacy policy.

Your Responsibilities

By visiting the site, you agree to be responsible for your own equipment, for following applicable laws, and for behaving ethically and reasonably. For example, you agree not to use the site to attack, stalk, or harass us or anyone else, not to disrupt or interfere with the site, not to impersonate others in your use of the site, not to impersonate or falsify the site or its messages, and not to attempt to access private or confidential information through the site. You also agree to evaluate all provided information yourself and not to hold us responsible for incorrect information provided in good faith.

Copyright and Licensing

Unless otherwise noted or arranged, the information on this site is copyrighted and subject to worldwide intellectual property protections.

If you provide information to us, you agree to provide us with a worldwide, non-exclusive, irrevocable, perpetual license to modify and use that information within the bounds of reasonableness and legality. You also warrant that you have the right to provide us with such a license. This includes publishing material you send to us, other than data clearly covered under our privacy policy (such as contact information intended for other purposes, including, for example, when you subscribe to a newsletter or request information on our privacy policies and practices.) For example, if you send us a “letter to the editor,” we may edit and republish that material on our site without requesting further consent from you and if you submit a comment, we may edit that comment and display it on our site (or via a third-party site acting on our behalf).

We respect the intellectual property rights of others and do our best to ensure all material that appears on the site adheres to the governing law to which we are subject in our jurisdiction. This may, at times, mean that material owned and copyrighted by others appears on our site without their permission under the doctrine of “fair use.”

If you have a concern or notice infringing material, please contact us and we will follow the applicable law in evaluating and, potentially, removing it.

Outside Providers, Services, Links, and Information

Services on this site may be provided by third parties. In such cases, we are both bound by their terms.

We may provide links to other sites or resources. We do not guarantee or take responsibility for such third-party materials, nor should such links be considered endorsements.

Warranties and Liabilities

We expressly disclaim all warranties about the site. You use it “as is” and “at your own risk.”

Nothing on this site is intended as legal advice, no legal representation is created by any use or communication through this site, and you agree to consult your own licensed attorney rather than relying on any information provided by this site.

We disclaim all liability for use of this site or for your reliance on the information we provide through this site, subject to the limits of applicable law.

If applicable law invalidates any part of these terms, it shall not invalidate the rest, and the relationship shall revert to the standard and reasonable one that would have applied absent the term or terms.

Governing Law

As the site is controlled and managed from California, in general, all applicable governing law is that of the State of California in the United States of America. You consent to the hearing of all court issues either in the County of San Diego, San Francisco, or Alameda, at the sole discretion of the site and its operators.

Steps to Rectify

If you, or a government body, notifies us that we must comply with additional laws or regulations, you agree to give us 90 days after we actually receive such notice before taking any further action to enforce such laws or regulations. Please contact us as soon as possible in such circumstances.

Changelog

August 7, 2017: Switched from “terms of service” that reflected those of Automattic, Inc. We still share those values, but these new terms reflect the non-commercial nature of the site.
